What can you do after a wrong-site surgery?

Imagine waking up from surgery to remove a diseased kidney only to be told that the surgeon accidentally excised the healthy organ and left the diseased kidney in place. Now, you are facing a lifetime on dialysis.

How could this have happened? Unfortunately, wrong-site surgeries happen with alarming frequency. This umbrella term includes surgeries:

  • Performed on the wrong patient
  • On the wrong side of the patient's body
  • On the wrong body part
  • At the wrong level of the correct site

Also called "never events," wrong-site surgeries often happen due to misinterpreted reports from the radiologist or letters from the clinic.

Of course, once it happens, the damage is done. You are still left with a diseased kidney that must be removed and face a lifetime of being tethered at regular intervals to a dialysis machine. Your prospects are decidedly worse than they were when you entered the hospital for your surgery.

While your future may not look nearly as bright, that doesn't mean that you have to accept your fate meekly. While it cannot mitigate your worsened health condition, seeking legal redress for your surgeon's atrocious mistake is an option that is available to you.

Seeking civil justice accomplishes multiple goals. It allows you to pursue compensation that can make adjusting to life under these conditions easier. It also holds the negligent medical professional liable for your injuries and damages, which may make them and others more careful in the future. And finally, it allows you to find a measure of closure after the egregious incident that disrupted your life.
