Wrong-site surgeries are never events that still occur

Having surgery is a major event. Patients are understandably apprehensive about the outcome, especially if an organ is being removed. After all, all sorts of problems can develop when the surgeon operates.

You could have an allergic reaction to the anesthetic. The surgeon could accidentally nick an artery while excising the organ tissue. The results could indicate an aggressive cancer has already metastasized.

But probably the worst thing to fear is an entirely preventable error like wrong-site surgery. Yet, these never events happen with alarming frequency.

It's important to note that not all surgical errors can be prevented. When a surgeon is cutting close to a vital organ or artery to remove a malignant growth, they try to leave margins that are free of cancerous cells. Their diligence can potentially result in a nick that causes massive blood loss. That is a surgical risk you undertake for a shot at being cancer-free.

But if that same surgeon instead removes your healthy kidney and not the diseased one, they are condemning you to a foreshortened life tethered to a dialysis machine for hours at a time several times a week. All because a protocol wasn't followed and negligence ensued.

If you suffered an egregious surgical error that could easily have been prevented, you need to understand the rights that you have to hold the negligent party or parties liable for the damage they have caused.

In some cases, surgical errors are fatal. Then, the survivors of the deceased patient have the right to file a wrongful death action. We can help you seek civil justice after a medical mistake. It may be the only path to justice that you have in these instances.
